dc.description.abstract	O presente artigo tem por objetivo apreender e explicitar a relevância da figura do corretor de imóveis e defender a legalidade do pagamento da sua remuneração – a chamada “comissão de corretagem” – pelo cliente comprador do imóvel no mercado primário. Considerou-se na análise a evolução história do tema e os diplomas legais que regulam a matéria, bem como a decisão do Superior Tribunal de Justiça no REsp 1599511/SP que reforçou certos entendimentos e introduziu uma questão que carece de maior discussão: o não reconhecimento da contratação direta do corretor de imóveis pelo comprador, o que contraria o funcionamento do mercado primário de lançamento de imóveis e a prática comercial adotada nesse mercado quanto ao pagamento da comissão de corretagem.	pt_BR
dc.description.other	The objective of this paper is to understand and explain the importance of the party known as real estate agent and advocate for the legality of the commission’s payment by the buyer of the estate. This analysis takes into consideration the historical evolution of this subject and the legislation involved in its regulation, as well as a decision by the Brazilian’s Supreme Court of Justice (“Superior Tribunal de Justiça” – STJ, Decision REsp 1599511/SP) which emphasized some interpretations and introduced an understanding which still needs further discussion: the decision of the Court to not acknowledge the payment of the real estate agent by the estate buyer, which contrasts with the market’s practice and the traditions regarding the commission’s payment.	pt_BR
