A regulação da educação superior no Brasil: mecanismos e instrumentos utilizados pelo Ministério da Educação (MEC)

Abstract

O trabalho tem como objetivo analisar a regulação da educação superior privada no Brasil a partir da atuação do Ministério da Educação (MEC), e outros órgãos e entidades, com foco em seus principais mecanismos e instrumentos avaliativos. A pesquisa busca compreender o percurso histórico, os fundamentos jurídicos e a estrutura institucional que consolidaram o sistema regulatório do setor. Inicialmente, apresenta-se o conceito de serviço público e a expansão do ensino privado, evidenciando a tensão entre interesse coletivo e lógica de mercado. Em seguida, discutem-se as teorias da regulação, os agentes envolvidos e os marcos normativos relevantes, como a Constituição de 1988, a LDB/1996 e a criação do SINAES em 2004. Os resultados indicam que a avaliação, por meio de instrumentos como ENADE, CPC e IGC, tornou-se eixo central das decisões regulatórias, com impacto direto em políticas como FIES e ProUni. Verifica-se que essa integração fortaleceu a supervisão estatal, mas também gerou limitações, sobretudo pela dependência de indicadores quantitativos. Conclui-se que a experiência brasileira demonstra avanços institucionais no monitoramento e na qualidade da educação superior, mas ainda enfrenta o desafio de conciliar a dimensão formativa da avaliação com sua função regulatória.

The study aims to analyze the regulation of private higher education in Brazil through the role of the Ministry of Education (MEC) and other agencies and entities, with a focus on their main mechanisms and evaluative instruments. The research seeks to understand the historical trajectory, legal foundations, and institutional framework that have consolidated the regulatory system of the sector. Initially, it presents the concept of public service and the expansion of private education, highlighting the tension between collective interest and market logic. It then discusses regulatory theories, the actors involved, and key legal frameworks, such as the 1988 Constitution, the LDB/1996, and the creation of SINAES in 2004. The findings indicate that evaluation, through instruments such as ENADE, CPC, and IGC, has become the central axis of regulatory decisions, directly impacting policies such as FIES and ProUni. It is observed that this integration has strengthened state supervision but has also generated limitations, particularly due to reliance on quantitative indicators. The study concludes that the Brazilian experience demonstrates institutional advances in monitoring and ensuring the quality of higher education, while still facing the challenge of reconciling the formative dimension of evaluation with its regulatory function
