dc.description.abstractO objeto do presente estudo é verificar historicamente e conceituar o instituto da alienação fiduciária em garantia de bens imóveis, estabelecer diferenças entre esta garantia real e outras existentes no ordenamento jurídico brasileiro, tocar em pontos positivos e vantajosos do instituto que se apresentou como revolucionário perante as dificuldades enfrentadas para satisfação de obrigações avençadas sobre o manto da legislação aplicável. Demonstrar os pontos frágeis e polêmicos, tendo em vista, o objetivo para o qual a legislação foi criada, situar a importância da aplicação e expor os pontos controversos buscando diagnosticar possíveis soluções, mesmo diante do conflito aparente entre a legislação que norteia o instituto e outras normas de mesmo grau de importância conflitantes. Enfim buscar consolidar entendimentos, criar alternativas dissertando possíveis soluções para temas controversos, sempre com intuito de equilibrar a rigidez legal com as obrigações fáticas do mundo negocial real.pt_BR
dc.description.otherThe object of the present study is to verify historically and conceptualize the institute of fiduciary alienation in guarantee of real estate, to establish differences between this real guarantee and other existing ones in the Brazilian legal order, to touch on positive and advantageous points of the institute that presented itself as revolutionary before the difficulties encountered in satisfying contractual obligations on the applicable legislation. To demonstrate the fragile and controversial points, in view of the objective for which the legislation was created, to place the importance of the application and to expose the controversial points in order to diagnose possible solutions, even in the face of the apparent conflict between the legislation that guides the institute and other conflicting standards of the same degree. Finally, we seek to consolidate understandings, to create alternatives, dissolving possible solutions to controversial issues, always with the aim of balancing legal rigidity with the phatic obligations of the real world of business.pt_BR
