Descongestionando a Justiça: Uma Análise da Eficiência dos Juizados Especiais Cíveis (JEC) no Brasil

Resumo
No presente estudo, foi investigada a eficácia dos Juizados Especiais Cíveis (JECs) como resposta à morosidade no sistema judiciário brasileiro. Criados para lidar com litígios de baixa complexidade e promover o acesso à justiça de modo mais célere, os JECs enfrentaram o desafio contínuo de agilizar procedimentos e reduzir prazos judiciais. Primeiramente, examinou-se a história e os desafios contemporâneos enfrentados pelo JECs como uma medida alterativa para enfrentar a demora persistente no Poder Judiciário. Para isso, utilizou-se a Análise Envoltória de Dados (DEA), a partir da análise relativa das unidades estaduais dos JECs, além da comparação dos coeficientes de eficiência obtidos com os resultados perante a Justiça Comum. Ao final, constatou-se que os JECs, de certo modo, cumpriram com seu objetivo primordial de mitigar os efeitos prejudiciais da morosidade no Poder Judiciário, promovendo uma maior celeridade e, assim, aliviando o congestionamento da Justiça Comum.
In the present study, the effectiveness of the Civil Special Courts (JECs) as a response to the delays in the Brazilian judicial system was investigated. Created to handle low-complexity disputes and promote swifter access to justice, the JECs faced the ongoing challenge of expediting procedures and reducing judicial deadlines. Initially, the historical and contemporary challenges faced by the JECs were examined as an alternative measure to address the persistent delays in the Judiciary. For this purpose, Data Envelopment Analysis (DEA) was employed, based on the relative analysis of the state units of the JECs, in addition to comparing the efficiency coefficients obtained with the outcomes before the Common Justice. In conclusion, it was found that the JECs, to some extent, fulfilled their primary objective of mitigating the harmful effects of judicial delays, promoting greater swiftness, and thus alleviating the backlog of the Common Justice system.
