Resumo
Em 2026, o Brasil ocupou a quinta posição no ranking mundial de feminicídios, com uma taxa de 4,8 homicídios por mulheres por 100 mil habitantes. De acordo com os dados da Organização Mundial da Saúde, 1 em cada 3 mulheres de 15 a 49 anos nas Américas sofreram violência física e/ou sexual por um parceiro ou violência sexual não-parceira. Além disso, 1 em cada 4 mulheres com 15 anos ou mais já sofreram violência física e/ou sexual por parte de um parceiro. No estado de São Paulo, no ano de 2023, 30% das mulheres paulistas já sofreram algum tipo de violência doméstica ou familiar provocado por homem, sendo 20% tendo episódio de violência ocorrido entre o ano de 2022 e 2023.Com um judiciário predominantemente masculino, com a participação de juízas representando cerca de 37%, é importante entender como os casos de Lei Maria da Penha, sendo essas vítimas mulheres, estão sendo julgados e condenados. Esse estudo busca complementar a literatura com uma visão crítica ao sistema judiciário brasileiro.
O principal objetivo deste trabalho é analisar de que forma o sexo dos magistrados pode influenciar a severidade das condenações em casos envolvendo a Lei Maria da Penha. Na primeira etapa do estudo, foram utilizados dados provenientes do Tribunal de Justiça de São Paulo, referentes aos processos de 2024 relacionados a casos de violência doméstica. Esses dados são essenciais para o desenvolvimento da análise, pois permitem uma visualização detalhada das sentenças proferidas em casos específicos e revelam o sexo dos magistrados que assumiram a responsabilidade pelos julgamentos.
Por fim, será realizada uma análise econométrica com o objetivo de investigar se há uma influência entre o gênero do magistrado e a condenação proferida. Além disso, o estudo buscará analisar a relação entre os diferentes tipos de crimes cometidos e as sentenças aplicadas, visando entender se existe algum padrão ou tendência nas decisões judiciais conforme as características dos crimes e dos juízes envolvidos.

According to data from the World Health Organization, 1 in 3 women aged 15 to 49 in the Americas have experienced physical and/or sexual violence from a partner or non-partner sexual violence. Furthermore, 1 in 4 women aged 15 and older have experienced physical and/or sexual violence from a partner. In the state of São Paulo, in 2023, 30% of women had suffered some form of domestic or familial violence by a man, with 20% of these incidents occurring between 2022 and 2023. With a predominantly male judiciary, with female judges representing about 37%, it is crucial to understand how cases under the Maria da Penha Law, where the victims are women, are being judged and sentenced. This study aims to complement the literature with a critical perspective on the Brazilian judicial system. The main objective of this study is to analyze how the gender of judges may influence the severity of sentences in cases involving the Maria da Penha Law. In the first stage of the study, data from the São Paulo Court of Justice, referring to 2024 cases of domestic violence, was used. This data is crucial for the development of the analysis, as it provides a detailed view of the sentences in specific cases and reveals the gender of the judges who presided over them. Finally, an econometric analysis will be carried out to investigate whether there is an influence of the judge's gender on the sentence issued. Additionally, the study will examine the relationship between different types of crimes committed and the sentences applied, aiming to understand if there is any pattern or trend in judicial decisions based on the characteristics of the crimes and the judges involved.
