dc.description.abstractA prolífica literatura sobre independência judicial de fato sente falta de uma variável-chave para explicar o viés político: poder discricionário do governo sobre a nomeação de juízes da Suprema Corte. Neste artigo, ex ploramos uma característica distinta do sistema judici ário brasileiro para avaliar o viés político devido ao cri tério de nomeação do governo. Como existem dois tri bunais, o STF (Supremo Tribunal Federal) e STJ (Su perior Tribunal de Justiça), que lida com questões se melhantes e têm diferentes restrições sobre a nomeação de seus membros, é possível comparar o grau de in fluência política para que eles estão sujeitos. Nós testa mos (1) se existem diferenças no grau de influência po lítica, dependendo do critério do Presidente sobre a no meação de uma justiça e (2) se os juízes ativamente be neficiam o partido do Presidente que os nomeou. dc.description.otherThe prolific literature on de facto judicial independence misses a key variable to explain political bias: the gov ernment’s discretion over the appointment of Supreme Court Justices. In this paper, we explore a distinct fea ture of the Brazilian judiciary system to assess political bias due to government appointment discretion. As there are two courts, the STF (Supreme Federal Court) and the STJ (Superior Court of Justice), that deal with similar matters and have different restrictions on the ap pointment of their members, it is possible to compare the degree of political influence to which they are sub ject. We test (1) whether there are differences in the de gree of political influence depending on the president’s discretion over the nomination of a justice, and (2) whether the justices actively benefit the party of the president who has appointed them. We find evidence of the first effect, but little of the second.pt_BR
